These terms and conditions (the “Terms”) govern your use of our online platform, harleypharmacy.co.uk (the “Website”) and our smartphone applications (the “App”) (the Website and the App being collectively referred to as “our Platform”), as well as the Services and Products that are made available to you via the Platform.
Please read these Terms carefully and make sure that you understand them. If you wish to access the Products or Services on our Platform, you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be allowed to order Products or Services from our Platform.
1. Information About Us
1.1 These Terms apply to the online pharmacy services provided by Harley Pharmacy (“we”, “us”, “our”).
1.2 Harley Pharmacy is a registered pharmacy operating in London, England. We are registered with the General Pharmaceutical Council (“GPhC”).
1.3 Our superintendent pharmacist details are available on our Website and comply with GPhC registration requirements.

2. Definitions and Interpretation
2.1 In these Terms, the following definitions apply:
- “POM Products” means the prescription-only medicinal products which you order via our Platform and which are dispensed and dispatched by us for you
- “OTC Products” means the general sales list (GSL) products and such other non-prescription only products which are supplied by us to you via our Platform
- “Products” means POM Products and OTC Products, and where the context allows, each shall be a “Product”
- “Services” means the pharmacy services we provide through our Platform, including prescription dispensing, medication advice, and health consultations
- “you” and “your” means you, your dependents if any, and any other person accessing your patient account on our Platform (the “Patient Account”)
2.2 The words “include”, “includes” and “including” are deemed to be followed by the words “without limitation”; the word “or” is not exclusive; and the words “herein”, “hereof”, “hereby” and “hereunder” refer to these Terms as a whole.
3. Access to Our Platform
3.1 Access to our Platform is permitted on a temporary basis, and we reserve the right to withdraw or amend access to our Platform without notice.
3.2 We will not be liable if for any reason our Platform is unavailable at any time or for any period.
3.3 From time to time, we may restrict access to some parts of our Platform, or our entire Platform, to users who have registered with us.
3.4 You are responsible for making all arrangements necessary for you to have access to our Platform.
3.5 You are also responsible for ensuring that all persons who access our Platform through your internet connection are aware of these Terms and that they comply with them.
3.6 You must be at least 18 years old to use our Platform and purchase Products or Services. By using our Platform, you warrant that you are at least 18 years old.
4. Use of the Website
4.1 You may use our Platform only for lawful purposes. You may not use our Platform:
- In any way that breaches any applicable local, national or international law or regulation
- In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect
- To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam)
- To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs
4.2 You also agree:
- Not to reproduce, duplicate, copy or re-sell any part of our Platform in contravention of these Terms
- Not to access without authority, interfere with, damage or disrupt any part of our Platform, any equipment or network on which our Platform is stored, any software used in the provision of our Platform or any equipment or network or software owned or used by any third party
5. Creating an Account
5.1 To access certain Services on our Platform, you will need to register and create a Patient Account.
5.2 When you register, you must:
- Provide accurate, current and complete information
- Maintain and promptly update your registration information
- Maintain the security of your password and accept all risks of unauthorised access to your account
- Immediately notify us if you discover or otherwise suspect any security breaches related to our Platform or your account
5.3 You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account and password.
5.4 We reserve the right to disable any user account at any time if in our reasonable opinion you have failed to comply with any of these Terms.
6. Professional Standards and Qualifications
6.1 All pharmacy services provided through our Platform are delivered by registered pharmacists and pharmacy professionals who are registered with the General Pharmaceutical Council (GPhC).
6.2 Our pharmacists are bound by professional codes of ethics and conduct as set out by the GPhC. You can access these professional standards by visiting www.pharmacyregulation.org.
6.3 We comply with all relevant UK legislation including:
- The Human Medicines Regulations 2012
- The Medicines Act 1968
- The General Data Protection Regulation (UK GDPR)
- The Data Protection Act 2018
7. Privacy and Data Protection
7.1 We are committed to protecting your privacy and personal data. Our use of your personal data is governed by our Privacy Policy, which forms part of these Terms.
7.2 By using our Platform, you consent to our collection, use, and disclosure of your personal data in accordance with our Privacy Policy.
7.3 You acknowledge that we may need to share your personal data with:
- Healthcare professionals involved in your care (including your GP)
- The NHS Business Services Authority
- Regulatory bodies (GPhC, MHRA, CQC)
- Delivery service providers
- Payment processors
7.4 We will only share your data where legally required or where you have provided consent, and in accordance with our Privacy Policy.
8. Intellectual Property Rights
8.1 We are the owner or the licensee of all intellectual property rights in our Platform, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
8.2 You may print off one copy, and may download extracts, of any page(s) from our Platform for your personal use and you may draw the attention of others within your organisation to content posted on our Platform.
8.3 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
8.4 Our status (and that of any identified contributors) as the authors of content on our Platform must always be acknowledged.
8.5 You must not use any part of the content on our Platform for commercial purposes without obtaining a licence to do so from us or our licensors.
8.6 If you print off, copy or download any part of our Platform in breach of these Terms, your right to use our Platform will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
9. Accuracy of Information
9.1 We take care to ensure that all information available on our Platform about our services and products is accurate. However, we do not guarantee that such descriptions or other content on our Platform are accurate, complete, reliable, current, or error-free.
9.2 The content on our Platform is provided for general information only. It is not intended to amount to medical advice on which you should rely. You must obtain professional or specialist medical advice before taking, or refraining from, any action on the basis of the content on our Platform.
9.3 Although we make reasonable efforts to update the information on our Platform, we make no representations, warranties or guarantees, whether express or implied, that the content on our Platform is accurate, complete or up to date.

10. Disclaimer
10.1 THIS PLATFORM IS NOT AN EMERGENCY SERVICE AND IS NOT TO BE USED IF YOU ARE HAVING A MEDICAL EMERGENCY. IF YOU HAVE A MEDICAL EMERGENCY, PLEASE CALL 999 IMMEDIATELY.
10.2 We do not warrant or represent that:
- The material on this Platform is accurate, complete or current
- The Platform will be free of defects or viruses
- The Platform will be uninterrupted or error-free
10.3 Nothing contained in the pages of this Platform should be construed as medical, commercial, legal or other professional advice. Detailed professional advice should be obtained before taking or refraining from any action based on any of the information or material contained in this Platform.
10.4 The information provided on our Platform is not intended to replace a one-to-one relationship with a qualified healthcare professional and is not intended as medical advice.
11. Limitation of Liability
11.1 Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Breach of the terms implied by Section 12 of the Sale of Goods Act 1979 (title and quiet possession)
- Any other liability which cannot be excluded or limited under English law
11.2 Subject to clause 11.1:
- We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Platform
- We assume no responsibility for the content of websites linked to from our Platform. Such links should not be interpreted as endorsement by us of those linked websites
11.3 We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
- Use of, or inability to use, our Platform
- Use of or reliance on any content displayed on our Platform
11.4 We will not be liable for any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.

13. Governing Law and Jurisdiction
13.1 These Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law.
13.2 We both agree to the exclusive jurisdiction of the courts of England and Wales.
14. General
14.1 If any provision or part-provision of these Terms is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted.
14.2 Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these Terms.
14.3 No failure or delay by us to exercise any right or remedy provided under these Terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict our further exercise of that or any other right or remedy.
14.4 These Terms constitute the entire agreement between us and you relating to your use of our Platform and supersede all prior agreements and understandings.
